General terms and conditions of business
1. Scope
The following terms and conditions apply to all orders placed via our online shop.
2. Contracting parties, conclusion of contract
The purchase contract is concluded with HILO GmbH, Hadeldorfstrasse 10, 6812 Meiningen, Austria.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. After submitting the order, you will receive another confirmation by email.
3. Contract language, contract text storage
The language available for concluding the contract is German.
We save the contract text and send you the order data and our general terms and conditions by email. You can view the contract text in our customer login.
4. Right of withdrawal
Consumers generally have a right of withdrawal. Further information on the right of withdrawal can be found in the seller's cancellation policy.
5. Delivery conditions
In addition to the stated product prices, shipping costs may also be added. You can find out more about the shipping costs in the offers, at check out or here: https://hilosports.de/pages/versand-retouren.
We only deliver by post. Unfortunately, it is not possible to collect the goods yourself.
6. Payment
Credit card
During the ordering process you enter your credit card details.
Your card will be charged immediately after placing your order.
PayPal, PayPal Express
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the ordering process.
Google Pay
In order to pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, identify yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further information during the ordering process.
Amazon Pay
In order to pay the invoice amount via the payment service provider Amazon Payments Europe SCA 38 avenue JF Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, identify yourself with your access data and confirm the payment order. The payment transaction will be carried out within one banking day after the order has been placed. A banking day is every working day with the exception of Saturdays, federal public holidays and December 24th and 31st of each year. You will receive further information during the ordering process.
Klarna Sofort Transfer
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will find further information in the respective payment option and in the ordering process.
EPS transfer
In cooperation with the payment service provider EPS, Sofort Überweisung payments are made possible.
Purchase on account via Klarna
The invoice amount is only due after the goods have been dispatched and the invoice has been received.
7. Retention of title
The goods remain our property until delivery.
8. Transport damage
If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and contact us immediately. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the freight carrier or transport insurance.
9. Warranty and guarantees
The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found on the product and on special information pages in the online shop.

10. Dispute settlement
The European Commission provides a platform for online dispute resolution (ODR), which you can find here https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
11. Applicable law
Austrian law applies to all legal relationships between the parties, excluding the laws governing the international sale of movable goods. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his or her habitual residence.
12. Place of jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contract is the seller's place of business. If the customer is based outside of Austria, the seller's place of business is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. In the above cases, however, the seller is in any case entitled to take legal action before the court at the customer's place of business.
Changes to the Terms of Sale: The Seller reserves the right to make changes to its website and these Terms and Conditions at any time. The Terms and Conditions in force at the time the Customer places the order will apply to the order, unless a change to these Terms and Conditions is required by law or by government order (in which case they will also apply to orders you have previously placed). If any provision of these Terms and Conditions is invalid, void or unenforceable for any reason, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
Minors: We do not offer products for purchase by minors. Our products can only be purchased by adults. If the customer is under 18, he or she may only use the online store with the involvement of a parent or guardian.
